Understanding why plea negotiations are used

Being accused of a crime is not an easy situation to be in. It also is not easy to think of ways to reduce the impact of this situation. Defendants are often overwhelmed by the situation, making it difficult to see all criminal defense options available to them. Litigation is not always a must, and there are defense options that could reduce the charges or penalties faced by the accused.

Plea bargains may not be the go to defense option most people see in the movies or on television; however, it is very common in the legal system. It is also a process that benefits both sides. It can save time and money while also opening up the court system for other cases. In fact, roughly 90 percent of all criminal cases are resolved through plea negotiations.

So what is a plea negotiation? This is considered an agreement between the prosecutor and the defendant. These agreements usually involve a defendant pleading guilty to the charges in exchange for facing a lesser charge or a reduced sentence.

So when are these used? Plea bargains are considered a good idea in various situations. Courts tend to be overcrowded. By offering these plea negotiations, this frees up the court. Additionally, it reduces the caseloads of prosecutors, allowing them the time they need to focus on more serious cases. Finally, defendants are able to save time and money by not going through the process of defending themselves at court.

Because all defendants are afforded the right to a legal defense, it is important to gain a full perspective of the types of defenses. By doing this, defendants can determine the best step to take for their present and future.
